By downloading, installing, or using TopSwing Tracer ("the App"), you agree to be bound by these Terms of Use. If you do not agree, do not use the App.
We grant you a limited, non-exclusive, non-transferable, revocable license to use the App on Apple-branded devices that you own or control, as permitted by the Apple App Store Terms of Service.
You are responsible for keeping your sign-in credentials confidential and for all activity under your account. VIP access is linked to your TopSwing account and can be restored on your other devices by signing in.
The App, including its design, code, tracer effects, and branding, is owned by TopSwing Tracer and protected by intellectual property laws. These terms do not grant you any ownership rights.
The App is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Ball tracking and tracer outputs are provided for entertainment and training assistance and are not guaranteed to be accurate.
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for the App or subscription in the twelve months preceding the claim.
We may suspend or terminate your access if you breach these terms. You may stop using the App and delete your account at any time.
If there is any conflict between these Terms of Use and Apple's Standard End User License Agreement, Apple's Standard EULA applies. Apple is not responsible for the App or its content, has no obligation to provide maintenance or support, and is a third-party beneficiary of these terms with the right to enforce them against you.
We may update these terms from time to time. Continued use of the App after changes take effect constitutes acceptance of the updated terms.
